{"id":10977,"date":"2021-05-04T16:43:34","date_gmt":"2021-05-04T14:43:34","guid":{"rendered":"https:\/\/advancedfleetmanagementconsulting.com\/eng\/?p=10977"},"modified":"2021-05-04T16:43:34","modified_gmt":"2021-05-04T14:43:34","slug":"technology-3","status":"publish","type":"post","link":"https:\/\/advancedfleetmanagementconsulting.com\/eng\/2021\/05\/04\/technology-3\/","title":{"rendered":"Using technology to prevent nuclear verdicts"},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">Telematics software and dash cams are critical to recreating crash events and can help commercial truck fleets quickly sort out the truth.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">In the unfortunate event of a truck-related fatality, it\u2019s common for the driver steering the 18-wheeler, and company he or she works for, to get the blame. It\u2019s no help to the trucking community that the photographs of the scene play up the horror element: a chunk of highway surrounded by yellow police tape and shaded red by ambulance lights, where the passenger cars are mangled messes of steel and the semi stands intact.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">That trucker must have fallen asleep, been on their phone or just not be very good at their job, many seeing such images reason. While those are all possible reasons for a crash, of course, the data tells a different story.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">A 2002 <a style=\"color: #0000ff;\" href=\"https:\/\/www.researchgate.net\/publication\/255603485_Identifying_Unsafe_Driver_Actions_that_Lead_to_Fatal_Car-Truck_Crashes\" target=\"_blank\" rel=\"noopener noreferrer\">American Automobile Association (AAA) study<\/a> using 1995-1998 data assigned driver-related factors on the part of passenger car drivers 80% of the time in fatal car-truck crashes versus 27% for commercial truck drivers.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">According to a <a style=\"color: #0000ff;\" href=\"https:\/\/news.umich.edu\/most-fatal-crashes-involving-heavy-trucks-are-not-the-fault-of-truckers-u-m-study-says\/\" target=\"_blank\" rel=\"noopener noreferrer\">University of Michigan Transportation Research Institute in 2007<\/a>, passenger cars are solely at fault 70% of the time, while truck drivers cause the crash 16% of the time. In 10% of cases, both parties failed to act in a safe and legal manner.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">The American Trucking Associations (ATA) used this study for a 2013 report, which received pushback from <a style=\"color: #0000ff;\" href=\"https:\/\/www.fleetowner.com\/safety\/article\/21684825\/truck-safety-coalition-attacks-ata-truckcar-crash-data\" target=\"_blank\" rel=\"noopener noreferrer\">the Truck Safety Coalition<\/a>, which called the report \u201ca fallacious attack on victims of truck crashes\u201d that had \u201cno scientific basis.\u201d<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">There has not been any major research into the topic since the advent of advanced driver-assistance systems, which include collision mitigation and lane departure and blind-spot warnings. This technology should likely help reduce all crashes, though it\u2019s unknown what impact that has on assigning fault in crashes between trucks and light vehicles. The Federal Motor Carrier Safety Administration <a style=\"color: #0000ff;\" href=\"https:\/\/www.fleetowner.com\/safety\/article\/21120679\/fmcsa-to-reexamine-fatal-crash-causes\" target=\"_blank\" rel=\"noopener noreferrer\">is currently mulling<\/a> a new Large Truck Crash Causal Factors Study (LTCCS) to better understand the issue.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">ATA President Chris Spear also noted in testimony to Congress in 2019 that truck crashes were \u201con the rise\u201d and that \u201cinitiating a new Large Truck Crash Causation Study would be an effective tool in understanding the increase in large truck-involved crashes.\u201d<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">Whatever the findings revealed by a new LTCCS, the known data at the very least shows truckers and the fleets they drive for should not immediately be branded as the guilty party, just as any U.S. citizen should be assumed innocent until proven guilty. And in the age of telematics and dash cams, understanding what happened during a crash, and who is at fault, becomes far more clear. Specifically, the addition of sensors and cameras has allowed fleets to reconstruct crashes in real-time.<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span style=\"color: #0000ff;\">Visualizing the crash with data<\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">A telematics company started in Dublin called Xtract uses accelerometer and GPS data to provide a visual representation of a crash almost instantly. The software, which operates through major telematics providers such as Geotab, helps fleets and their insurers get a sense of what happened and why, taking into account speed, vehicle positioning on the road, and even weather.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">It\u2019s all about discovering that \u201c10 seconds of truth,\u201d Xtract CEO Michael Flanagan told\u00a0<i>FleetOwner<\/i>. Sometimes the truth is that the car perhaps cut off a truck or ran a red light, and other times it\u2019s because the truck driver made a mistake. And everything is set up in the Xtract360 app with the claims handler in mind, which ultimately helps the fleet.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">\u201cFrom that moment of impact to the moment when the claims handler sees the reconstruction of the crash is about 60 seconds,\u201d Flanagan said, noting previously this may have taken three weeks, and sometimes important information, such as the driver statement, could have been written with pen and paper.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">In a presentation in Munich demoing Xtract\u2019s capabilities, Flanagan showed a case where a truck was making a turn and collided with a car.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">Within seconds, the insurance handler received a reconstruction that included a satellite view of the road with an icon of the truck moving south. Braking data showed the truck slowed before turning right, but not enough to avoid hitting another vehicle at a g-force of 5.6. The weather conditions indicated it was raining and at night. The algorithm immediately judged the truck 100% liable given the variables.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">Next, the claims handler can access the license plate info of the third party and based on the g-force, point of impact, and make and model, know if the car is totaled or repairable. The modeling can also predict injuries to the driver.<\/span><\/p>\n<p><center><iframe title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/sZQQ3N7Yr8o\" width=\"560\" height=\"315\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><center><br \/>\n<center><\/center><\/center><center><\/center><center><\/center><center><\/center><\/center><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">\u201cHaving this information quickly helps [insurance handlers] make the right decisions early and means the fleet\u2019s truck gets back on the road faster, and they get to keep their costs down,\u201d Flanagan explained. \u201cThey also get the payout on claims that they should payout.\u201d<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">For the claims handler, which in the U.S. includes <a style=\"color: #0000ff;\" href=\"https:\/\/axaxl.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">AXA XL<\/a>, all this is incredibly important as the longer it takes to figure out, the more costs accrue.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"color: #0000ff;\" data-embed-type=\"image\" data-embed-id=\"608c02532f5c1344158b49b8\"><img class=\" lazyloaded\" src=\"https:\/\/base.imgix.net\/files\/base\/ebm\/fleetowner\/image\/2021\/04\/xtarct_screenshot.608c0252baea7.png?auto=format&amp;fit=max&amp;w=1440\" alt=\"Xtract360 allows claims handlers and fleets to get a crash reconstruction within a minute of the event, and allows the handler to quickly assess and manage liability.\" data-src=\"https:\/\/base.imgix.net\/files\/base\/ebm\/fleetowner\/image\/2021\/04\/xtarct_screenshot.608c0252baea7.png?auto=format&amp;fit=max&amp;w=1440\" data-image-id=\"608c02532f5c1344158b49b8\" \/><\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"color: #0000ff;\" data-embed-type=\"image\" data-embed-id=\"608c02532f5c1344158b49b8\"><span class=\"caption\">Xtract360 allows claims handlers and fleets to get a crash reconstruction within a minute of the event, and allows the handler to quickly assess and manage liability.<\/span><span class=\"credit\">Credit: Xtract<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">\u201cRather than having to process a sea of disjointed data, you get a clear, cohesive real-world view and are able to interpret the crash and figure out what really happened,\u201d said insurance consultant and author Bryan Falchuk on Xtract&#8217;s technology. \u201cIt brings much more in-context order to the overall claim file, which actually sounds simple, but is incredibly powerful.\u201d<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">Everything is digital and organized, speeding up the claims process. Falchuk, managing partner of Insurance Evolution Partners and author of <a style=\"color: #0000ff;\" href=\"https:\/\/www.amazon.com\/Bryan-Falchuk\/e\/B06VWFGJ5S%3Fref=dbs_a_mng_rwt_scns_share\" target=\"_blank\" rel=\"noopener noreferrer\">&#8220;The Future of Insurance,&#8221;<\/a> noted there could be 78 documents or more for one claim, from witness statements to photos, and are often organized by date, making it difficult to visualize a crash event.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">The longer this takes, the harder it is to help make those affected whole again, which Falchuk said is the root of why insurance exists in the first place.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">\u201cIt&#8217;s there to protect people at the worst moments of their lives and help put them put the pieces back together,\u201d he said. \u201cThat&#8217;s a really important and noble cause. And I think we lose sight of that.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">And presenting the data in the most honest and accurate way is the right thing to do.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">\u201cIf you can recreate the event, you can do a better job at helping people,\u201d he said.<\/span><\/p>\n<div id=\"content-body-21162804\" class=\"page-contents__content-body\" style=\"text-align: justify;\">\n<p><span style=\"color: #0000ff;\">Tim McCarthy, Xtract&#8217;s EVP of business development, noted that for claims under $100,000, the data allows a trucking company involved in a crash to potentially swing the verdict to the fleet\u2019s favor, or adjust the at-fault percentage in arbitration from 100 or 75% down to 50%, for example.<\/span><\/p>\n<p><span style=\"color: #0000ff;\">\u201cHaving a decision about the outcome of that claim quickly is a really big deal, McCarthy noted. \u201cYou don&#8217;t want to be sitting out there for a year or two years, and that happens with some of the high-liability cases. Everybody lawyers up.\u201d<\/span><\/p>\n<p><span style=\"color: #0000ff;\">With the facts of the crash right in front of them, there is less need for a court case, and possibly a jury that could render a nuclear, or multimillion-dollar, verdict, against the fleet. \u201cNo one really knows what juries will do until they do it,\u201d McCarty said. \u201cYou want to avoid that if you can.\u201d<\/span><\/p>\n<h3><span style=\"color: #0000ff;\">Dashcams<\/span><\/h3>\n<p><span style=\"color: #0000ff;\">While the data tells a story of the crash that\u2019s hard to deny, then having the actual crash on video removes all doubt in most cases.<\/span><\/p>\n<p><span style=\"color: #0000ff;\">First off, this is key to avoiding nuclear verdicts and also incorrectly blaming the fleet\u2019s driver. In one instance involving Atlas Trucking where a passenger car driver was left a quadriplegic, the police report faulted the truck driver, but video evidence showed that was incorrect.<\/span><\/p>\n<p><span style=\"color: #0000ff;\">Without the video, Atlas would have \u201cfired the driver immediately, and we\u2019d probably be facing a $40 million lawsuit that we would have lost,\u201d Jeff Bronson, senior director of transportation at Atlas <a style=\"color: #0000ff;\" href=\"https:\/\/www.fleetowner.com\/technology\/article\/21120541\/video-turns-the-corner-fleets-and-drivers-focusing-on-techs-benefits\">told <i>FleetOwner<\/i><\/a>.<\/span><\/p>\n<p><span style=\"color: #0000ff;\">There used to be the old chestnut of fleet reluctance to adopt dash cams due to the invasion of privacy, or Big Brother effect. But in reality, the dashcam videos are only looked at when there is a reason to, and this often vindicates the driver.<\/span><\/p>\n<p><span style=\"color: #0000ff;\">\u201cWe hear stories that range from video proving that a driver didn\u2019t tear up Mrs. Smith\u2019s flower beds, to cases where video shows plaintiffs backing into parked trucks,\u201d reported Ryan Driscoll, VP of marketing at <a style=\"color: #0000ff;\" href=\"https:\/\/www.gpsinsight.com\/solutions\" target=\"_blank\" rel=\"noopener noreferrer\">GPS Insight<\/a>, which provides driver management and dashcam solutions. \u201cOne of our client\u2019s drivers reported rear-ending another vehicle. The fleet manager thought this would mean the insurance companies would find his driver at fault. After reviewing the camera footage, they agreed that it was the other driver&#8217;s fault for cutting off our client&#8217;s driver and slamming on their brakes. This wouldn&#8217;t be possible without video footage.\u201d<\/span><\/p>\n<p><span style=\"color: #0000ff;\">According to Driscoll, GPS Insights\u2019 tracking and smart cameras can reduce accident claims by 70-90%. And the tactical use of edge computing allows one safety manager to monitor the dash cams of 100 drivers and reduce claims \u201cwhile spending little or no additional hours managing their driver\u2019s behavior,\u201d he said.<\/span><\/p>\n<p><span style=\"color: #0000ff;\">\u201cThe\u00a0camera costs less than a tank of gas each month, and with the money you will save on fuel spend, it can pay for itself,\u201d Driscoll added.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"color: #0000ff;\" data-embed-type=\"image\" data-embed-id=\"608c024366c9037c158b49b6\"><img class=\" lazyloaded aligncenter\" src=\"https:\/\/base.imgix.net\/files\/base\/ebm\/fleetowner\/image\/2021\/04\/gpsinsight_crash_avoided.608c024264eb4.png?auto=format&amp;fit=max&amp;w=1440\" alt=\"GPS Insight's Smart Camera system can not only record accidents, but also near misses. Verdicts against trucking companies rose 483% year-over-year from 2017 to 2018, <a style=\"color: #0000ff;\" href=\"https:\/\/www.google.com\/url?sa=t&amp;rct=j&amp;q=&amp;esrc=s&amp;source=web&amp;cd=&amp;ved=2ahUKEwjDsbbvtYDvAhXNMlkFHQikC24QFjAAegQIAhAD&amp;url=https%3A%2F%2Ftruckingresearch.org%2Fwp-content%2Fuploads%2F2020%2F06%2FATRI-Understanding-the-Impact-of-Nuclear-Verdicts-on-the-Trucking-Industry-06-2020-2.pdf&amp;usg=AOvVaw0ismufiDZEuAhJHVuGJiuS\" target=\"_blank\" rel=\"noopener noreferrer\">according to the American Transportation Research Institute (ATRI).<\/a><\/span><\/p>\n<p><span style=\"color: #0000ff;\">\u201cIn many of the cases that we hear, the video is all that opposing counsel needs to see to dismiss claims, so these cases don\u2019t even get before a judge or a jury,\u201d Driscoll said.<\/span><\/p>\n<p><span style=\"color: #0000ff;\">Along with avoiding nuclear verdicts, video helps curtail \u201ccrash-for-cash\u201d schemes, said Driscoll, who added these grifts <a style=\"color: #0000ff;\" href=\"https:\/\/www.autoinsurancecenter.com\/crash-for-cash.htm\">cost insurance carriers $20 billion annually<\/a>. These costs are passed down to all policyholders. And Driscoll said businesses are often the car con artists\u2019 mark.<\/span><\/p>\n<p><span style=\"color: #0000ff;\">He recounted one case where the video exonerated the truck driver and also proved the woman in the passenger vehicle was not thrown from her car, as she claimed. The case was dropped upon video review.<\/span><\/p>\n<h3><span style=\"color: #0000ff;\">Nuclear armistice<\/span><\/h3>\n<p><span style=\"color: #0000ff;\">Not all fleets face nuclear cases, but they are all at risk for a collision just by having trucks on the road. That\u2019s the mentality fleets must take in adopting the best technology to evade predators, if Falchuk\u2019s warnings are to be believed.\u00a0<\/span><\/p>\n<p><span style=\"color: #0000ff;\">\u201cThere&#8217;s a nuclear arms race in litigation,\u201d he asserted. \u201cThere&#8217;s literally investment dollars flowing into the plaintiffs\u2019 bar to fund these cases because the return on that investment is massive.\u201d<\/span><\/p>\n<p><span style=\"color: #0000ff;\">His solution is certainly not to throw more lawyers at the problem, but that is what\u2019s happening.<\/span><\/p>\n<p><span style=\"color: #0000ff;\">\u201cThere isn&#8217;t really much the insurance industry can do other than spending on even better lawyers,\u201d Falchuk said. \u201cThat&#8217;s not a long-term play. All we&#8217;re doing is we&#8217;re trading indemnity dollars for adjusting dollars and defense dollars.
